Wild nightlife: Brescia residents compensated

A historic Supreme Court ruling recognizes the damage caused by "noise emissions." Protests in many Italian cities follow Brescia's example.

Anyone who lives in any historic center of any Italian city (large, medium or small) knows the problem well: the din of the nightlife. Noises until late at night, dirty streets and sidewalks, frequent fights, homes unreachable. Faced with the inertia of local governments, citizens organized themselves, even going to court. And obtaining a verdict, Brescia, which could set an example for all of Italy.

WILD NIGHTLIFE IN BRESCIA: CITIZENS COMPENSATED

Thanks to a sensational ruling of the Court of CassationBrescia residents will be compensated for "noise emissions." Quantifying the damages and how the money will be distributed will be up to the Court of Appeal in a new ruling. Brescia's story begins in 2012 when lawyer Gianfranco Paroli and his wife Piera Nava, exhausted by the damage caused by the movidaAfter exhausting everything, they resorted to legal action. And they took the municipality to court. The curious aspect of the affair is that at the time, the mayor of Brescia was Adriano Paroli, Gianfranco's brother, and currently Forza Italia's commissioner in the city. At first instance, Paroli's lawyer prevailed and even obtained an initial compensation amount: €20. However, they lost their appeal, until the final ruling of the Supreme Court of Cassation arrived in May 2023. The judges' reasoning recognized the municipal administration's "objective responsibility" when it failed to ensure compliance with basic rules protecting its property and the coexistence of its citizens. While awaiting the compensation amount, the Brescia precedent, which, being a Supreme Court ruling, will set a precedent, has sparked outrage among citizens in many other Italian cities. One example: In L'Aquila, the residents of the historic center, led by Claudia Aloisio, have united, also via social media, and have decided to sue the municipalityAs happened in Brescia.
